The Length of Mesothelioma Lawsuits

PDF E-mail

While there are no firm rules regarding the length of a Mesothelioma lawsuit, the preparation of the case can take approximately six months. This includes obtaining medical records and having them reviewed by an expert, finding the defendants in the case and filing all the necessary paperwork.

In the case of cases brought to the Federal court, they are transferred to Pennsylvania, where a multi-district litigation court will handle all the pre-trial matters. Unfortunately, with so many cases to file, it can take as long as 15 years to resolve your case. This means some plaintiffs may never live to see his case resolved.  Some law firms will bring your case to a state court. The process involving the state court is generally resolved more quickly; often just two to three years after the case was filed. The majority of asbestos trials actually take about two weeks.

The important thing to remember is that there are multiple variables that will affect the length of your case. Who files your case and where it is filed makes a difference.
